After seeing the new Producer Pact and it's legal dancing around issues, I believe we as Producers need FULL Clarification if all the Royalties and Licensing fees are in FACT paid by Radionomy for the radio stations we provide to them???

This is the text from the original pact in French:
"Radionomy héberge et diffuse les Radios créées sur sa plateforme et supporte tous les frais afférents aux droits de diffusion."

Seems clear to me that all costs related to rights are covered by them. The English translation is a bit fuzzier unfortunately.

The French version translates to:

Radionomy hosts and streams Radios created on its platform and supports all expenses relating to broadcasting rights

Apparently the issue now is the word royalties has been removed from both.

This is definitely the new pact in French, just taken from the French forum and posted yesterday as well. Broadcasting rights has to mean royalties, otherwise what does it mean? I do not know of any other broadcasting rights. Droits de diffusion in French translates indeed to broadcasting rights and that means royalties (at least in the French meaning). I grant you that in the old pact that specifically mentioned SABAM, now it's less clear. Since Bivendi is French, they'll use SACEM instead? That I'm not sure.

Broadcasting rights means the right to broadcast a signal over the Internet or a frequency, it has nothing to do with copyrights, Radionomy has stated very clearly in their new pact if you have any issues with copy righted material or illegal music they will not be held liable. So producers we are now personally responsible for all the content we broadcast, if we don't have permission to broadcast copyrighted material or paying proper royalties to play copyrighted material, Legal action will be taken against the producer personally, not Radionomy

Two points.

First, Radionomy is doing its usual terrible job of communicating, and the result is that a lot of producers are panicking over nothing.

Second, there is a logical reason for Radionomy to say that it covers "all costs relating to broadcasting rights" -- and not simply say "royalties."

That's because there is more than one type of royalty.

Disclaimer: I'm not a lawyer, I just did a little reading about music royalties. And I'm not a Radionomy employee, so this isn't official. But here's how this all makes sense to me:

"Broadcasting rights" might not be the best term, and maybe that's the whole Producers Pact is translated from French. But in this context the language clearly means Radionomy covers the rights to transmit legally obtained music over its streams. Same as before!

There is another type of royalty that Radionomy doesn't pay - never did, never will. That's the royalty that is charged when you purchase a recording. Assuming you got your music through legitimate means - not from file-sharing or torrent sites - you already paid that royalty. (Or if the music was given to you for free by the copyright holder, the royalty was waived.)

So - don't panic! This language change really doesn't make a difference. Yes, you have to pay to purchase the music that you upload and play. No, you don't have to pay to broadcast it on Radionomy.
